These Terms of Service ("Terms") apply to your use of blacknwhitestudio.com and to enquiries and engagements with Black & White Studio ("we", "us"), a software development studio based in Dhaka, Bangladesh. By using the website or engaging us, you agree to these Terms.
Our own apps listed on the products page have their own terms of use, linked from each app's page. Those terms apply when you use those apps.
2. Using this website
- You may browse and share links to this website for any lawful purpose.
- Don't attempt to disrupt, overload, scrape at scale or gain unauthorised access to the site or its infrastructure.
- Don't submit spam, malicious code or false information through our contact form.
3. Website content
The text, design, graphics, screenshots, logos and code on this website belong to Black & White Studio unless stated otherwise. You may quote short extracts with a link back to the source. Please don't republish whole pages or use our branding without written permission.
Our case studies note when they are representative scenarios built from real customer conversations, rather than named client accounts. Named deployments are identified as such.
4. Enquiries, estimates and quotations
- Information on this website about services, timelines or prices is general and may change without notice.
- Rough estimates given before a requirements discussion are indicative only.
- A project starts only when both sides agree a written quotation, proposal or contract (by email or signed document) covering scope, price, payment schedule and timeline.
5. Client projects
For each engagement, the agreed project document sets out the specific terms, including scope, deliverables, payment milestones, ownership of code and intellectual property, warranty or support periods, and hosting responsibilities. Where it is silent, these general principles apply:
- Changes in scope are quoted separately before work starts on them.
- Client materials (content, data, logos, credentials) remain yours. You confirm that you have the right to give them to us.
- Third-party services your software depends on, such as hosting, SMS gateways, payment gateways, app stores and maps, are governed by those providers' terms and charges.
- Confidentiality: we keep your business information confidential and use it only to deliver your project. See our Privacy Policy.
- Portfolio: we won't name you or show your project publicly without your permission.
6. Third-party links
This website links to other sites such as Google Play, WhatsApp and social networks. We are not responsible for their content or practices.
7. Disclaimer
This website is provided "as is". We work to keep it accurate and available, but we don't guarantee that it will be error-free or uninterrupted. Nothing on this website is legal, financial or tax advice.
8. Limitation of liability
To the extent permitted by law, Black & White Studio is not liable for indirect or consequential losses arising from use of this website. For client projects, liability is as set out in the project agreement.
9. Governing law
These Terms are governed by the laws of Bangladesh. Any dispute will first be discussed in good faith. If it can't be resolved that way, it falls under the jurisdiction of the courts of Dhaka, unless a project agreement says otherwise.
10. Changes
We may update these Terms from time to time. The "Last updated" date shows the current version. Changes don't affect project agreements already signed.
