These Terms of Service ("Terms") govern your access to and use of the Mobile Fleet platform — including the web dashboard, backend services, mobile device agent, APIs, and any related documentation (the "Service") — provided by Black & White Studio ("we", "us", "our"). By signing up, enrolling a device, or using any part of the Service, you agree to these Terms on behalf of your organization ("Customer", "you").

Monthly fees are non-refundable. For annual prepaid contracts, refunds are pro-rated only if we materially breach these Terms and fail to cure within 30 days of written notice.
We offer a 30-day free pilot for up to 10 devices, no credit card required. At the end of the pilot you may upgrade to a paid plan or stop using the Service. If you do not upgrade, we will retain your tenant data for 14 days to allow restart, and then delete it.
You agree NOT to use the Service to:
You are responsible for informing enrolled-device end users about monitoring and policy enforcement as required by your local law (e.g., GDPR Article 88, employment law, labor councils).
You retain ownership of all data you submit to the Service ("Customer Data"). You grant us a limited licence to process Customer Data solely to operate the Service for you, in accordance with our Privacy Policy and Data Processing Addendum. We do not use Customer Data to train AI models.

Excludes scheduled maintenance (announced 72h in advance), force majeure, and outages caused by Customer misconfiguration or third-party networks.
We maintain administrative, technical, and physical safeguards designed to protect Customer Data, consistent with industry-standard practices and aligned to ISO/IEC 27001 and SOC 2 Type II controls. A summary is available at the Security section of the homepage and in our DPA.
NOTICE file in the agent build).Each party will protect the other's Confidential Information using at least the same degree of care it uses for its own (and never less than reasonable care). Confidential Information does not include information that is publicly available, independently developed, or rightfully received from a third party without confidentiality obligations.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect or prevent every loss, theft, or misuse of an enrolled device.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption — even if advised of the possibility.
You will defend and indemnify us against third-party claims arising from (a) your violation of these Terms, (b) your enrollment of devices without proper authority, (c) your violation of applicable employment, privacy, or surveillance law, or (d) Customer Data that infringes third-party rights.
These Terms are governed by the laws of Bangladesh, without regard to its conflict of laws principles. Disputes shall be brought in the competent courts of Dhaka, Bangladesh. Enterprise customers may negotiate alternative jurisdiction in a signed Order Form.
We may update these Terms to reflect product changes, legal requirements, or industry standards. Material changes will be announced in the admin dashboard and by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
